Brief considerations on contractual obligations in US law

Abstract

To understand how contractual enforcement functions in the United States legal system, a common law tradition without a general theory of obligations, like Mexico´s Neo-romanist system, one must examine the underlying paradigm of legal coercion. This framework facilitates commercial exchance and serves to avoid disputes between private parties. The subject encompasses broad philosphical and moral dimensions, but this paper explores the foundational principles of early United States law to clarify the paradigm upon which this function is built.
